TERMS STATUS

This Agreement sets out the terms currently published by REALVEX Studio for the Services covered by it.

As REALVEX Studio Services develop over time, this Agreement may be reviewed and updated where reasonably necessary. The “Last Updated” date identifies the current published version.

1. Acceptance and Scope

This Agreement establishes the general terms governing access to and use of REALVEX Studio Services as a whole.

The Services may include, without limitation, games, applications, software, websites, digital products, online features, content, communication channels, community features, development materials, promotional materials, and other products or services made available by REALVEX Studio.

For the purposes of this Agreement:

“REALVEX Studio,” “REALVEX,” “we,” or “us” refers to REALVEX Studio in connection with the Services covered by this Agreement.

“User,” “you,” or “your” refers to any person who accesses, downloads, installs, launches, purchases, or uses a REALVEX Studio Service.

By using an applicable Service, you agree to comply with this Agreement and any additional terms that may apply to that Service.

If you do not agree to this Agreement, you must stop using the applicable Service.

2. Services as a Whole

This Agreement provides a general framework for the use of REALVEX Studio Services as a whole.

A specific Service may have additional rules, licenses, technical requirements, purchase conditions, or other terms where necessary. Those terms may apply together with this Agreement.

3. Eligibility and Lawful Use

You must use REALVEX Studio Services in accordance with applicable laws and regulations.

You are responsible for ensuring that your use of a Service is legally permitted in your region.

Where applicable law requires parental or legal guardian consent for a minor, that consent must be obtained where required.

The Services may not be used for unlawful or prohibited purposes.

4. License to Use Software and Games

Subject to this Agreement and any applicable additional terms, REALVEX Studio grants you a personal, limited, non-exclusive, non-transferable, and non-sublicensable license to use applicable software or games for their intended and authorized purpose.

This license does not transfer ownership of the software, source code, development technology, or intellectual property to you.

5. Intellectual Property

REALVEX Studio and the applicable rights holders retain ownership of their respective intellectual property and protected materials made available through the Services.

These materials may include:

• Software and source code.

• Game systems and technologies.

• Graphics and visual effects.

• 3D models, textures, and materials.

• Sound effects and music.

• Characters and environments.

• Stories and written content.

• User interfaces and designs.

• Images and videos.

• Names, logos, and trademarks.

• Documentation and other protected materials.

Use of a Service does not transfer ownership of these materials to you.

No ownership rights are transferred unless expressly stated in a separate written agreement or required by applicable law.

6. Use Restrictions

Unless expressly authorized by REALVEX Studio or otherwise permitted by applicable law, you may not:

• Copy or distribute protected software or game files without authorization.

• Sell, rent, lease, sublicense, or commercially exploit protected software without authorization.

• Repackage, mirror, upload, or redistribute protected software through unauthorized channels.

• Attempt to obtain source code through reverse engineering, decompilation, or disassembly where such restriction is legally permitted.

• Modify protected core software or game files without authorization.

• Remove, disable, or bypass technical protection or security mechanisms.

• Extract protected assets or resources for unauthorized use outside the applicable Service.

• Use REALVEX Studio assets in another project without appropriate authorization.

• Create or distribute unauthorized cheating tools.

• Use unauthorized software intended to interfere with a Service.

• Attempt to access systems, servers, accounts, files, or data without authorization.

• Introduce malware, malicious code, or harmful files.

• Circumvent technical, access, account, or security restrictions.

Nothing in this section is intended to restrict a right or legal exception that cannot lawfully be restricted.

7. Unauthorized Distribution

Unauthorized copying, public sharing, uploading, mirroring, repackaging, or redistribution of protected REALVEX Studio software, game files, or other protected materials is prohibited.

Users should obtain REALVEX Studio software and games through official or authorized distribution channels where such channels are provided.

The public availability of an unofficial copy does not make that copy authorized.

This section does not affect rights or legal exceptions that REALVEX Studio cannot lawfully restrict.

8. Third-Party Materials and Services

Some REALVEX Studio Services may contain, use, link to, integrate with, or depend on third-party software, technology, assets, libraries, content, trademarks, platforms, or other services.

Such materials and services remain subject to the rights, licenses, terms, privacy policies, technical requirements, and restrictions of their respective owners or providers.

REALVEX Studio does not control independent third parties, including their content, availability, policies, or data practices.

9. Trademarks, Branding, and Impersonation

The name REALVEX Studio, related names, logos, branding, and other identifiers may be protected by applicable intellectual property rights.

You may not use REALVEX Studio branding in a way that falsely suggests an official partnership, sponsorship, endorsement, employment, authorization, or affiliation.

You may not impersonate REALVEX Studio, its representatives, developers, staff, official channels, or other persons or entities in a manner intended to mislead others.

You may not create or operate a website, account, application, service, page, or communication that falsely presents itself as being operated by, authorized by, or officially affiliated with REALVEX Studio.

10. Websites and Online Services

REALVEX Studio may operate websites and online services containing information, announcements, project materials, media, documentation, contact information, or other content.

Website pages, layouts, features, navigation, content, availability, and technical functionality may change over time.

REALVEX Studio may add, modify, restrict, replace, suspend, or remove website features where reasonably necessary.

11. Published and Development Content

REALVEX Studio may publish news, announcements, development information, images, videos, demonstrations, project descriptions, promotional materials, technical information, and other content.

Unless expressly stated otherwise, such material is provided for informational or development purposes.

The publication or discussion of a project, feature, roadmap, estimated date, or development target does not by itself create a binding promise that it will be released or remain available.

12. Future Projects and Features

Future games, products, features, technologies, updates, or other projects may change during development.

REALVEX Studio may modify, delay, replace, suspend, or cancel projects, features, names, designs, content, schedules, or technical specifications where reasonably necessary.

A feature that is available or publicly discussed at one point in time is not necessarily guaranteed to remain permanently available.

REALVEX Studio is not required to release, complete, maintain, expand, or commercialize a future project unless expressly agreed otherwise.

13. Updates and Service Changes

REALVEX Studio may develop, update, improve, modify, replace, restrict, suspend, or discontinue aspects of its Services for technical, operational, security, legal, or development reasons.

Certain Services may require updates or patches to maintain security, compatibility, functionality, or continued operation.

Older versions may no longer be supported, compatible, available, or fully functional.

14. Service Availability, Performance, and Compatibility

REALVEX Studio may make reasonable efforts to maintain its Services, but continuous, uninterrupted, or permanent availability is not guaranteed unless otherwise required by applicable law or expressly agreed.

Services may become temporarily unavailable because of maintenance, updates, technical work, security measures, infrastructure changes, or other legitimate reasons.

Availability may also be affected by circumstances outside REALVEX Studio's reasonable control, including hardware failures, software failures, operating systems, networks, hosting providers, distribution platforms, internet connectivity, or other external technical factors.

Actual performance may vary between devices and configurations.

Performance may depend on processors, memory, graphics hardware, drivers, operating systems, system settings, third-party software, and other technical factors.

REALVEX Studio does not guarantee identical performance across all devices or configurations and does not guarantee that every Service will operate on every device, operating system, hardware configuration, software environment, or network.

15. “AS IS” and “AS AVAILABLE”

To the maximum extent permitted by applicable law, Services may be provided “AS IS” and “AS AVAILABLE.”

REALVEX Studio may make reasonable efforts to maintain and improve its Services but does not guarantee that every Service will always be free from errors, interruptions, vulnerabilities, or technical issues.

Nothing in this section excludes any legal right, guarantee, warranty, or liability that cannot lawfully be excluded or limited.

16. Cheating, Interference, and Security

You may not use unauthorized cheats, exploits, scripts, automation, modifications, software, or other methods intended to obtain an unauthorized advantage or improperly alter the intended operation of a game or Service.

You may not intentionally manipulate, corrupt, disrupt, damage, or improperly interfere with a Service or its intended operation.

You may not attempt to access servers, accounts, administrative systems, restricted files, infrastructure, or data without authorization.

You may not bypass authentication, access controls, security mechanisms, or other technical restrictions without authorization.

You may not introduce malware, malicious code, destructive files, or other harmful mechanisms into a Service or related systems.

Where you discover a potential security vulnerability, you are encouraged to report it through an appropriate official communication channel without exploiting it for unauthorized or harmful purposes.

17. Conduct

REALVEX Studio Services and official communication channels must be used in a lawful and reasonably respectful manner.

You may not use them for:

• Threats or extortion.

• Fraud or deliberate deception.

• Persistent harassment.

• Impersonation.

• Malware distribution.

• Unauthorized access.

• Deliberate disruption.

• Other unlawful activity.

Unlawful threats, harassment, intimidation, extortion, or malicious targeting of REALVEX Studio developers, staff, representatives, or collaborators may be addressed in accordance with applicable law and the nature of the conduct.

18. Lawful Criticism and Reviews

Users retain the right to express lawful opinions, criticism, reviews, suggestions, and negative feedback concerning REALVEX Studio and its Services.

A negative review or unfavorable opinion, by itself, is not a violation of this Agreement.

Lawful criticism does not become prohibited merely because it is unfavorable to REALVEX Studio.

19. User-Provided Content

Where a Service allows users to submit or publish content, you remain responsible for the content you submit.

You may only submit content that you have the right or authorization to provide.

Submitting your content does not transfer ownership of that content to REALVEX Studio unless a separate applicable agreement expressly provides otherwise.

REALVEX Studio does not obtain ownership of User Content merely because you submit it through a Service.

20. User Content and Moderation

You may not submit content that:

• Unlawfully infringes the rights of others.

• Violates applicable law.

• Contains malicious code.

• Is intentionally used to harm the Services or their users.

Where a Service includes community or user-submitted content, REALVEX Studio may remove, restrict, disable, or decline to publish content where reasonably necessary to comply with law, protect users or Services, or enforce applicable rules.

21. Accounts

Certain REALVEX Studio Services may require an account.

Account requirements may vary depending on the Service or third-party platform used.

You are responsible for taking reasonable care of your account credentials and for preventing unauthorized access to your account.

Accounts may not be used for impersonation, fraud, unauthorized access, circumvention, abuse, or other prohibited activity.

22. Temporary Restrictions and Suspension

Where permitted by law, REALVEX Studio may temporarily restrict or suspend an account, Service, feature, or other functionality where reasonably necessary for security, maintenance, legal compliance, investigation, serious abuse, or protection of the Services.

Where reasonably appropriate and legally permitted, an opportunity to remedy a violation may be provided.

23. Privacy and Data Protection

REALVEX Studio will handle personal information it directly collects through its Services in accordance with applicable law and any applicable privacy notice.

The ordinary operation of the REALVEX Studio website is not intended to involve the intentional collection of personal information by REALVEX Studio unless a specific feature or function requires it.

Third-party platforms and service providers used to host, display, distribute, communicate, or otherwise provide Services may independently collect or process technical or other information under their own terms and policies.

REALVEX Studio does not control independent third-party data practices.

Where REALVEX Studio introduces a feature that requires the collection or processing of personal information, the applicable information and practices will be provided in accordance with applicable law.

24. Purchases and Paid Services

Where REALVEX Studio offers paid games, content, products, or Services, additional purchase terms may apply.

Payment may be processed by REALVEX Studio or by an authorized third-party platform or payment provider.

Prices, applicable taxes, payment methods, purchase conditions, refunds, and other commercial information will be presented through the applicable purchase process or platform where required.

25. Consumer Rights, Refunds, and Cancellation

Nothing in this Agreement is intended to remove or restrict mandatory consumer rights or legal remedies.

Refunds, cancellations, withdrawal rights, and other consumer remedies are governed by applicable law and the terms applicable to the relevant transaction or platform.

26. Saved Data and Data Loss

Where a Service does not expressly provide guaranteed cloud storage or backup, users should maintain appropriate copies of locally stored data where reasonably possible.

Updates, device failures, software failures, file corruption, system changes, deletion, or third-party services may result in loss or alteration of locally stored data.

27. Beta, Preview, and Experimental Versions

REALVEX Studio may make beta, preview, testing, experimental, or other early versions of a Service available.

Such versions may contain bugs, incomplete features, temporary systems, performance problems, compatibility issues, or substantial changes.

Progress, saves, settings, accounts, features, or other data associated with test versions may not remain compatible with later versions where technically necessary.

28. Technical Support

REALVEX Studio may provide technical assistance or support through available official channels.

Unless expressly guaranteed, support availability does not create a promise that every device, configuration, third-party modification, or technical issue will be supported.

29. Feedback and Suggestions

Users may submit feedback, suggestions, ideas, reports, recommendations, or other comments concerning REALVEX Studio Services.

REALVEX Studio is not required to implement, publish, respond to, or use every suggestion or item of feedback.

Submitting feedback does not automatically create a right to payment, ownership, attribution, or another benefit unless separately agreed in writing.

30. Unreleased and Confidential Materials

Unreleased games, builds, prototypes, source code, assets, development materials, private communications, and other non-public materials may be protected against unauthorized disclosure or use.

You may not intentionally disclose or use protected unreleased or confidential materials obtained without authorization.

31. Suspension and Termination

You may stop using a Service at any time.

REALVEX Studio may suspend or terminate access to a Service, account, or applicable license rights where permitted by applicable law, including for material violation of this Agreement, unlawful use, fraud, or serious security-related abuse.

Where reasonably appropriate and legally permitted, REALVEX Studio may provide an opportunity to remedy a violation before termination.

Upon termination or expiration of applicable rights, you must stop any use that is no longer authorized.

Provisions that by their nature should remain effective after termination may continue to apply to the extent permitted by law.

32. Limitation of Liability

To the maximum extent permitted by applicable law, REALVEX Studio and persons acting on its behalf shall not be liable for indirect, incidental, special, consequential, or similar damages arising from the use of, or inability to use, a Service where such limitation is legally permitted.

Nothing in this section excludes liability that cannot legally be excluded or limited.

33. User Responsibility for Unlawful Conduct

To the extent permitted by applicable law, you may be responsible for claims or damages arising directly from your unlawful conduct, intentional misconduct, material violation of this Agreement, or unlawful infringement of third-party rights.

This section does not create liability where applicable law does not permit responsibility to be assigned to you.

34. Force Majeure

To the extent permitted by law, REALVEX Studio will not be responsible for delays or failures caused by circumstances reasonably beyond its control.

Such circumstances may include natural disasters, widespread infrastructure failures, major network outages, governmental actions, war, or major technical incidents.

35. Regional Availability

Certain Services, content, products, features, or distribution methods may not be available in every country or region.

36. Platform and Device Requirements

Where a Service is distributed through a third-party platform, you may also be subject to that platform's applicable rules and requirements.

You are responsible for maintaining a compatible device, operating system, software environment, and internet connection where such requirements are necessary to use a Service.

REALVEX Studio does not guarantee compatibility with unauthorized modifications, unofficial patches, altered versions, third-party software, or unsupported configurations.

37. Official Information and Unofficial Claims

Official announcements, updates, policies, and important information should be obtained through the official communication channels designated by REALVEX Studio.

Users should exercise caution regarding websites, accounts, messages, or individuals falsely claiming to represent REALVEX Studio.

38. Governing Law

To the extent permitted by applicable law, this Agreement shall be governed by the laws of the Kingdom of Morocco, without prejudice to mandatory legal protections applicable to the User.

39. Dispute Resolution

Where appropriate, the parties should attempt to resolve disputes through good-faith communication before initiating formal proceedings, unless immediate legal action is permitted or required.

40. Competent Courts

Subject to applicable mandatory jurisdiction and consumer-protection rules, disputes may be submitted to the competent courts of Morocco.

41. Severability

If any provision of this Agreement is determined to be invalid or unenforceable under applicable law, the remaining provisions shall remain effective to the maximum extent permitted.

42. No Waiver

Failure to enforce a provision at a particular time does not constitute a permanent waiver of that provision or any other applicable right.

43. No Partnership or Agency

Nothing in this Agreement creates a partnership, agency, employment relationship, or joint venture between the User and REALVEX Studio.

You may not represent that you are authorized to act on behalf of REALVEX Studio without official authorization.

44. Assignment

Nothing in this Agreement permits a transfer of rights or obligations where such transfer is prohibited by applicable law.

Any transfer, restructuring, or assignment by REALVEX Studio remains subject to applicable law and does not remove mandatory rights of Users.

45. Entire Agreement

This Agreement, together with applicable Service-specific terms and policies expressly incorporated into it, constitutes the general contractual framework governing the applicable Services.

46. Amendments to this Agreement

REALVEX Studio may update this Agreement where reasonably necessary to reflect changes in law, Services, technology, security, operations, or development.

The Last Updated date identifies the current published version.

Where reasonably appropriate and legally required, material changes may also be communicated through applicable official channels.

47. Continued Use

Where legally permitted, continued use of an applicable Service after updated terms become effective may constitute acceptance of the revised Agreement.

Where additional consent is legally required, the applicable consent process shall be followed.

48. Preservation of Legal Rights

Nothing in this Agreement is intended to:

• Remove rights granted to Users by applicable law.

• Prevent lawful criticism, reviews, opinions, or feedback.

• Exclude liability that cannot legally be excluded or limited.

• Give REALVEX Studio powers beyond those permitted by applicable law.

• Transfer ownership of User Content or third-party intellectual property without an appropriate legal basis.

• Require a User or REALVEX Studio to violate mandatory applicable law.

Where a provision conflicts with mandatory applicable law, the mandatory law shall prevail to the extent of that conflict, while the remaining provisions shall continue to apply to the maximum extent legally permitted.

49. Reservation of Rights

All rights not expressly granted under this Agreement remain reserved by REALVEX Studio or the applicable rights holder, subject to applicable law.

Nothing in this Agreement grants rights by implication beyond those expressly provided.

IMPORTANT NOTICE

This Agreement is intended to regulate the use of REALVEX Studio Services as a whole in a clear, understandable, and fair manner.

Nothing in this Agreement is intended to:

• Remove rights granted to Users by applicable law.

• Prevent lawful criticism, reviews, opinions, or feedback.

• Exclude liability that cannot legally be excluded or limited.

• Give REALVEX Studio powers beyond those permitted by applicable law.

• Transfer ownership of User Content or third-party intellectual property without an appropriate legal basis.

• Guarantee the release of any future game, product, feature, update, or service.

• Guarantee uninterrupted operation, universal compatibility, or a specific performance level.

Where a provision conflicts with mandatory applicable law, the mandatory law shall prevail to the extent of that conflict, while the remaining provisions shall continue to apply to the maximum extent legally permitted.
